In October 1994, the NAFTA Free Trade Commission established the NAFTA Advisory Committee on Private Commercial Disputes, as called for in Article 2022 of the NAFTA. The Committee is required to report and make recommendations to the Commission on general issues referred to it by the Commission on the availability, use and effectiveness of arbitration, mediation, and other procedures for the resolution of private international commercial disputes in the free trade area. The Committee is composed of private sector members from the United States, Mexico and Canada, and two representatives of each country who jointly chair the Committee.
